California’s “Be a Manager, Go to Jail” law—officially known as the Corporate Criminal Liability Act (Penal Code § 387)—holds individual managers and supervisors personally liable if they knowingly hide serious workplace dangers.

What the Law Does

  • Who it applies to: Managers or executives with safety authority or significant responsibility over a product, facility, equipment, process, or workplace.

  • The offense: Having actual knowledge of a “serious concealed danger” (a condition that is not readily apparent and creates a substantial probability of death, great bodily harm, or serious exposure) and failing to fix it or warn affected employees and Cal/OSHA.

  • Timeframes: You must abate the hazard or issue warnings to exposed individuals and Cal/OSHA within 15 days (or immediately if there is an impending risk).

Penalties

  • For Individuals: Can be charged with a misdemeanor or a felony, carrying up to 3 years in state prison (or county jail time) and/or fines up to $25,000.

  • For Corporations/LLCs: Fines can reach up to $1,000,000.
